What Are the EB-5 Visa Investment Requirements?

The EB-5 visa program requires foreign investors to make a significant capital investment in a new commercial enterprise that creates or preserves at least 10 full-time jobs for U.S. workers.

The investment amount depends on the location of the business:

  • Targeted Employment Area (TEA) - $800,000 minimum investment for businesses located in rural areas or areas with high unemployment rates.
  • Standard Investment - $1,050,000 minimum investment for businesses in other areas.

One of the most attractive features of the EB-5 program is that a single investment can benefit your entire immediate family. Your spouse and unmarried children under 21 years of age are eligible to receive green cards based on your investment, allowing your family to live, work, and study anywhere in the United States.

Who Qualifies for the EB-5 Visa?

The EB-5 visa is ideal for foreign nationals who have the financial resources to make a substantial investment in a U.S. business and who seek permanent residency for themselves and their families. Investors can either invest directly in their own commercial enterprise or participate in an EB-5 Regional Center project, which may offer more flexibility in meeting job creation requirements.

To qualify, you must demonstrate that your investment capital was obtained through lawful means and that your investment will create the required jobs within a specified timeframe. Our team of attorneys at Revilla Law Firm, P.A. can help you navigate the documentation requirements and ensure your application meets all USCIS standards.

The Path to Permanent Residency

Initially, approved EB-5 investors receive conditional permanent resident status for two years. Before the end of this period, you must file a petition to remove the conditions on your residency by demonstrating that you have maintained your investment and met the job creation requirements. Once conditions are removed, you and your family members receive permanent green cards. After maintaining permanent resident status for five years, EB-5 investors may be eligible to apply for U.S. citizenship through naturalization.
