DACA Rescission: A Bad Decision

By Antonio G. Revilla III

Miami immigration lawyer and Former U.S. Immigration Prosecutor

The rescission of DACA is cruel, unjust, and illogical. It punishes approximately 800,000 people for the actions of their parents, which is a blatantly un-American concept. Those affected could potentially face deportation when America is the only country they know, having spent the majority of their lives in the United States.

The rescission of DACA will tear apart families that consist of United States citizens in the majority of cases. It will also have a devastating impact on our economy. This is simply a racist and mean-spirited scapegoating act designed to appease Trump's waning base.

Trump's rescission of DACA, which he didn't have the courage to announce himself, is pernicious, pathetic, and petty.

It’s important to understand the impact the DACA rescission could have on you or a loved one. Below are some key points about the Trump administration’s announcement.

Some Important Points on DACA and associated EAD:

  • Any initial (first time) applications received after September 5, 2017, will be rejected.
  • Renewal and initial applications pending as of September 5, 2017, will be adjudicated.
  • Current beneficiaries who will expire between September 5, 2017 and March 5, 2018 can renew DACA and EAD between September 5, 2017 and October 5, 2017.
  • DACA grants and EAD approvals will not be revoked during the validity period of the grant.
  • Advance Parole will no longer be granted.
  • Validity of approved advance parole will be honored.
  • Pending applications for advance parole will be administratively closed and the filing fees will be refunded.
