When President-Elect Donald Trump is inaugurated on January 20, 2017, one of the most anticipated policies likely to be impacted by his administration is immigration, an issue that arguably enhanced the appeal of his candidacy. Throughout his campaign, the President-Elect trumpeted a tough stance on immigration and repeatedly vowed to strengthen policies and enforcement of immigration laws, in addition to building a wall to mitigate undocumented immigration to our country.
Immigration policy enforcement is controlled by the executive branch through the Department of Homeland Security. So, if Trump follows through with his campaign promise of making immigration a priority, stricter enforcement could be expected in the coming year. While we cannot precisely predict Trump’s plan for immigration, we can encourage those in need of immigration help and defense to explore the opportunities still available to them.
While many fear the challenges a Trump administration could present to their immigration status, it’s important to emphasize that there’s still due process and ways to defend a person from being deported from the United States. Despite the potential changes to immigration policy, a person can still seek relief from removal and benefits, present arguments for them, and make a case for those benefits in immigration court and/or before the Department of Homeland Security (DHS).
Although it’s plausible that certain immigration policy changes and stricter enforceability will materialize during Trump’s administration, the outlook is by no means hopeless for those seeking asylum, legal status, lawful permanent residency, waivers, cancellation of removal in court to keep or seek residency, and the ability to apply for naturalization despite certain crimes.
The immigration process in this country will still provide opportunities for people who wish to stay in the United States and no wall or other attempt to unravel the fabric of our country will prevent the American Dream from being a beacon of hope and opportunity for so many in search of a better life.
