Immigration Reform

Antonio G. Revilla III is a passionate advocate for Immigration Reform. There are approximately 12 million illegal immigrants, maybe up to 18 million, in the United States. The United States is in dire need of Immigration Reform which will benefit the U.S. as a whole. Not only will Immigration Reform help unite families, and legalize individuals’ statuses, but it will also greatly improve the economy. In the United States there are millions of mixed families that consist of legal immigrants or United States citizens and illegal immigrants. These mixed status families are at risk of being torn apart if Immigration Reform is not passed.

Immigration Reform is not amnesty. If Immigration Reform passes it will most likely have a requirement that the individual has to have certain number of years of physical presence in the United States. There will also most likely be a requirement that the individual be a person of good moral character, which includes the filing of tax returns.

If Immigration Reform passes, it is anticipated that 245(i) will be reenacted. Section 245(i) of the Act would permit people who entered without inspection and other people presently ineligible for residency in the U.S. to become residents in the U.S.

Immigration Reform was expected to gain strength in 2010. There are already small changes in Immigration Law which offer glimmers of hope that Immigration Reform will eventually pass. For example, the widow penalty has been eliminated. This means that a widow or widower of a United States citizen does not have to be married for two years to be eligible for benefits under the Act.

The proposed Dream Act is a likely precursor to Immigration Reform. If passed, the Dream Act will greatly benefit minors that entered illegally or overstayed their visas. Once again there will be certain requirements for the Dream Act, including age, physical presence, and good moral character, as well as educational or military membership requirements.

As with any proposal such as Immigration Reform and the Dream Act the actual requirements are unknown until the bills are passed by the legislature and signed into law by the President.
